1. Introduction
   Welcome to HitFlow AI. These Terms of Service and Privacy Policy (the “Agreement”) govern your access to and use of our services, including our mobile app, website, APIs, and related features (collectively, the “Service”). By creating an account, downloading, or otherwise using the Service, you agree to this Agreement. If you do not agree, you must not use the Service. We may update these terms at any time. When material changes occur, we will attempt to notify you (for example, by email or in-app notice). Continued use of the Service means you accept the updated terms.

2. Eligibility and Account Registration
   You must be at least 13 years old to use the Service. If you are between 13 and 17 years old, you must have permission from a parent or legal guardian, who must read and agree to this Agreement on your behalf. We do not knowingly collect personal information from children under 13. You agree to provide accurate and current information and to update it when necessary. You are responsible for keeping your login information secure and for all activity on your account. We may suspend or terminate your account if you violate this Agreement.

3. Subscription Plans, Fees, and Billing
   We offer subscription plans as follows:
   Gold Monthly: $14.99 — unlimited macro food analysis and up to 30 AI video analyses per month.
   Platinum Monthly: $29.99 — unlimited macro food analysis and unlimited AI video analyses.
   Gold Annual: $154.99 — same features as Gold Monthly.
   Platinum Annual: $284.99 — same features as Platinum Monthly.
   Prices are in USD and may change with notice. Subscriptions are billed in advance and renew automatically unless cancelled. You may cancel anytime through your account settings or by contacting support. Access continues until the end of the paid period. Refunds are generally not provided unless required by law. Payments are handled by third-party processors such as Apple, Google, or Stripe, whose terms also apply.

4. Access Rules and Limits
   We grant you a limited, non-exclusive, non-transferable license to use the Service consistent with your subscription plan. You may not attempt to exceed usage limits or bypass technical restrictions.

5. User Content, Data, and Input
   You may upload content such as videos, photos, or workout data (“User Content”). By submitting User Content, you grant HitFlow AI a worldwide, royalty-free license to host, use, modify, and display your content to provide and improve the Service, including for AI model training and analytics, unless prohibited by law. You represent that you own or have the right to share the content you upload and agree not to submit illegal, harmful, or infringing material. We may remove content that violates this Agreement.

6. Privacy, Data Collection, and Use
   We collect information you provide such as name, email, age, gender, weight, and uploaded media; automatically collected data such as device information, IP address, and app usage; and derived data such as anonymized analytics.
   We use your information to provide, improve, and personalize the Service, manage subscriptions, communicate updates or offers, and ensure security and compliance.
   We share information only with service providers who help us operate the Service, with legal authorities when required, and in anonymized or aggregated form. We do not sell personal data to third parties.
   HitFlow AI is intended for users 13 years and older. We do not knowingly collect information from children under 13. Parents who believe their child has used the app may contact support@hitflowai.com for deletion.
   We keep your data as long as necessary to provide the Service or comply with legal requirements. We use reasonable safeguards to protect data, but no system is completely secure.
   Depending on your location, you may have rights to access, correct, delete, or export your data. Contact us to make a request.

7. Intellectual Property
   All content, software, and materials in the Service (except for your uploaded content) are owned by HitFlow AI or its licensors. You may not copy, modify, distribute, or sell them.

8. Acceptable Use
   You agree not to break laws, violate others’ rights, upload offensive or dangerous content, hack or disrupt the Service, impersonate others, or misuse data.

9. Disclaimers
   The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee accuracy, reliability, or suitability for your goals. You use the Service at your own risk.

10. Limitation of Liability
    To the fullest extent permitted by law, HitFlow AI’s total liability is limited to the greater of $100 or the amount you paid to us in the previous 12 months. We are not liable for indirect, incidental, or consequential damages such as loss of data or profits.

11. Indemnification
    You agree to defend and hold harmless HitFlow AI and its affiliates from any claims, damages, or costs arising from your use of the Service, your content, or your violation of this Agreement.

12. Termination
    We may suspend or terminate your account or access at any time. After termination, we may keep certain data as required by law.

13. Dispute Resolution and Governing Law
    This Agreement is governed by the laws of the jurisdiction in which HitFlow AI is incorporated. Disputes will be handled individually and not as part of a class action.

14. Third-Party Services
    The Service may integrate with or link to third-party tools. Their own terms and privacy policies apply.

15. Notifications
    We may contact you by email, in-app notice, or notification. You can opt out of marketing emails but not essential service messages.

16. Changes
    We may update this Agreement periodically. Continued use means you accept the latest version.

17. Miscellaneous
    If part of this Agreement is invalid, the rest remains valid. This is the entire agreement between you and HitFlow AI. You cannot transfer your rights to others. We are not responsible for delays caused by events beyond our control.

We comply with COPPA by not collecting data from users under 13.
